Definitions
  • Service Order means completed GT&T DSL application form (and any attachments thereto), signed by GT&T and the customer and to which these terms apply.
  • Agreement means the Service Order (and any attachments thereto) together with these terms, signed at the time of placing the Service Order.
Service
  • The GT&T DSL Internet Access Service (Service) provides dedicated, high-speed [maximum upload and download speed of 128Kbps] connections from a Customer's premise to the Internet via DSL local facilities and GT&T's Internet network.
  • At the originating Customer premise, the Customer's equipment places data into Internet Protocol packets (IP) and gives each packet a terminating address, and GT&T routes registered IP packets over its Internet network to the terminating Internet location or peering point with another Internet service provider.
DSL Service Requirements
In order to receive the DSL Service:
  • The customer must be at least 18 years old and provide appropriate identification

  • The Service must be available in the customer's location

  • The customer must be a wire line telephone service subscriber and you must ensure that your wire line service is not disconnected in order for the DSL Service to work. [Customers are responsible for their monthly DSL Service charge regardless of the status of their underlying telephone service.]

  • The customer's PC must meet the following minimum requirements:

  • 133 MHz (or faster) Pentium-based processor (or equivalent)

  • Windows 95b, Windows 98 and 98SE, Windows Me, Windows XP (Service Pack 2), Windows NT (4.0 Workstation with Service Pack 3 or higher; no server versions), and Windows 2000 (Service Pack 4)

  • 32MB RAM

  • 75MB of available hard disk space

  • All machines should have an installed, functional 10BaseT or 100BaseT Ethernet interface

  • The Service speeds [128/192/256 Kbps] indicated in this Agreement are maximum speeds. Actual speeds can vary depending on customer-specific location, line quality, inside wiring, Internet traffic, and other factors beyond the control of GT&T. GT&T provides the Service on a "best effort" standard and does not guarantee upload or download speeds.

  • For service installation and activation, the customer must ensure that the computer to be used is at maximum three (3) meters from the main telephone jack and that a standard wall outlet is available to provide power to the DSL equipment.

  • The service installation fee includes installation of the DSL modem provided by the customer.

  • GT&T will use best efforts to install and activate DSL service within 10 to 15 days of the date of placing an order with correct information. Installations are scheduled between 8:00A.M. and 5:00P.M. Monday through Friday, (except Holidays). Installation usually requires one to two hours and causes the customer's wire line service to be disrupted for a brief period. GT&T and the customer will agree on the date and time for installation.

  • The installation, inspection, maintenance, repair, and/or removal of equipment may result in service outage or potential damage to your computer. The customer is solely responsible for backing up all existing computer files and data. GT&T and its employees and representatives shall have no liability whatsoever for any damage to or loss or destruction of any of your hardware, software, files, data, or peripherals. You assume responsibility for impacts to or loss of any warranty associated with the opening of your computer for installation of an internal card (such as a Network Interface Card) or DSL modem.
Charges
  • The current price list is attached to and forms part of this Agreement.
  • The Customer will pay all applicable charges for the Service. From time to time GT&T may offer promotions with different terms, fees, and monthly charges.

  • The service installation and service activation charges are payable on the submission of the completed Service Order form. Depending on when the customer cancels a Service Order the customer could be entitle to a full refund of all monies paid. (See Cancellation). If GT&T determines that the customer line cannot be provisioned for DSL the customer receives a full refund of all monies paid.

  • DSL is sold on a pre-paid basis. The first monthly payment is payable on submission of the Service Order. It will cover a full month's service or a prorated amount to reflect the actual number of days of service to be enjoyed in the first month.

  • The monthly charge for service is due on or before the first day of the current period of service. GT&T reserves the right to suspend service for late payment. If service is suspended the total amount due and a reconnection fee of US$30.00 must be paid before service is restored.

  • The Customer acknowledges that this is a fixed-location service. Residential customers acknowledge that the service is to be installed on one personal computer only. Moving to another location will require the service to be cancelled. The customer must re-apply for service at the new location and pay all the charges associated with ordering a new service.
Term and Termination
  • Term: This contract is on a month-to-month basis and automatically renews each month unless the customer notifies GT&T in writing of their intent to cancel service.
  • Cancellation: If the customer is dissatisfied with the Service or any related terms, conditions, rules, policies, guidelines, or practices, the customer's sole remedy is to discontinue using the Service by canceling the Agreement. Customers can cancel this Agreement subject to the following conditions. Cancellation must be in writing. The customer must fill out the web page http://www.gol.net.gy, sign it, print it, and mail or fax the printed copy to GT&T Marketing Dept. [Attention Marketing Director] at least 30 days in advance. Effective Date:- Once a service has been activated, cancellations received less than 30 days in advance will take effect the last day of the following month, unless the customer specifies a cancellation date after that date. The customer pays all fees through the effective cancellation date. If a Service Order cancellation is received before the DSL circuit is installed all payments made by the customer are fully refundable. If a Service Order cancellation is received after the DSL circuit is installed only the service activation fee and the prepaid monthly fee are refundable. Once a service becomes operational, GT&T does not refund installation, activation, recurring monthly service or any other charges incurred prior to the effective cancellation date. GT&T does not monitor your circuit for activity and absence of activity or termination of your telephone service does NOT constitute a cancellation of the Agreement.

  • In addition to any other remedies available, GT&T may immediately (without notice and without liability to the Customer) discontinue the provision of Service if any of the following occurs: (a) GT&T deems in its absolute discretion that it is necessary to discontinue the Service in order to protect against its fraudulent or illegal use or to otherwise protect GT&T, its equipment, network or facilities; (b) GT&T receives complaints or claims from third parties regarding the Customer's use of the Service; or (c) The Customer fails to comply with its obligations pursuant to this Agreement; or The Customer fails to pay the applicable charges for the Service--or any other service supplied to the Customer by GT&T--on or before the due date. The PUC Orders GT&T to discontinue the sale of DSL.

  • GT&T will endeavor to give the Customer notice regarding the reason(s) for suspension or termination as soon as reasonably practicable after such suspension or termination.

  • In the event that the Service is discontinued for any reason specified in clause D 4 herein, if GT&T is willing to reconnect the Service, the Customer will, prior to such reconnection, pay all outstanding fees and charges and the relevant reconnection fee.

  • If during the term of this Agreement the customer has to relocate to a new location the customer must cancel this Agreement.

  • Technical Support: On-site technical support is not included. It is the customer's responsibility to initiate and be available for technical support during normal business hours [between 8:00A.M. and 5:00P.M. Monday through Friday, except Holidays]. GT&T will not be held responsible for outages that are not reported by the customer to GT&T.
Additional Rights and Obligations
  • GT&T will operate and maintain the Service, contingent upon GT&T's (i) ability to maintain its licenses and permissions, and (ii) availability of network capacity and connections.
  • The Customer will, at its own expense, be responsible for the acquisition of the requisite modem [either purchased from GT&T or based on GT&T's specifications and subject to GT&T's certification].

  • GT&T is not responsible for the installation, maintenance, compatibility or performance of any third party equipment or software not provided by GT&T, and if such third party equipment or software impairs the Service, (i) the Customer remains liable for his/her monthly payment, and (ii) if it is likely to cause hazard or service obstruction, the Customer will eliminate said equipment and/or software at GT&T's request.

  • It is acknowledged and agreed by the parties hereto that the download and upload bandwidth set out in this Agreement is the maximum bandwidth that can be achieved on the circuit and cannot be guaranteed by GT&T. GT&T will, however, use all reasonable efforts to achieve the highest possible level of Service at all times.

  • In the event that the Customer provides router(s) to interface with the Service, upon request by the Customer confirmed in writing, GT&T may assist the Customer in configuring the router(s) in order to implement and operate the Service. If router(s) are not recommended by GT&T nor certified by GT&T as compatible for use with the Service, GT&T may refuse to install and activate the service with the said router(s).

  • The Customer will give GT&T personnel reasonable access to its premises at all reasonable times.

  • The Customer will not misuse the Service (i.e. permit any use of the Service which is unlawful, harassing, or which infringes upon another's intellectual property rights, or which otherwise constitutes network abuse), and Customer will be responsible for any such misuse.

  • The Customer shall be solely responsible for providing for any security or privacy that the Customer may desire for its computer or computer network and any data stored on that computer or computer network or accessed through the Service. The Customer acknowledges and assumes all liabilities relating to, and risks associated with, unauthorized access by a third party via the Service to such computer or computer network and data.

  • GT&T may communicate security issues to Customer from time to time when misuse is observed or reported by others.

  • GT&T has no obligation to monitor the Service; however, GT&T may monitor the Service and disclose information gained from such monitoring in order to (i) satisfy any law, regulation or other governmental request, (ii) operate the Service and administer GT&T's networks, or (iii) protect itself or its subscribers.

  • GT&T reserves the right to refuse to post or to remove any information or materials, in whole or in part, that in its sole discretion are unacceptable, undesirable, or in violation of this Agreement.

  • The service does not facilitate international telephony activity and the customer shall not attempt to use the Service for the purpose of international telephony traffic Bypass [i.e. bringing in or sending out international telephone calls] nor for any other purpose prohibited by the Telecommunications Act of 1990.

  • DSL service shares the end user's current telephone line and service. It will be the customer's sole responsibility to remain current with his/her monthly payments for this service in order to receive the DSL services. Disconnected telephone service, or moving to a different address does not relieve the end-user of monthly service charge and contractual obligations.
Warranties and Liabilities
  • The Customer understands that GT&T does not operate or control the Internet.
  • THE CUSTOMER ASSUMES TOTAL RESPONSIBILITY FOR ITS USE OF THE INTERNET.

  • GT&T MAKES NO EXPRESS OR IMPLIED WARRANTIES, REPRESENTATIONS OR ENDORSEMENTS REGARDING ANY MERCHANDISE, INFORMATION, PRODUCTS OR SERVICES PROVIDED THROUGH THE INTERNET.

  • GT&T does not in any manner warrant any item of equipment provided by GT&T; GT&T will, however, transfer to the Customer (to the extent permitted by an equipment supplier) any warranty provided by such supplier, with GT&T retaining the authority to exercise Customer's rights there under until the discontinuation of service.

  • THE SERVICE IS PROVIDED ON AN ""AS IS""AND ""AS AVAILABLE"" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF TITLE, NONINFRINGEMENT OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

  • NO ADVICE OR INFORMATION GIVEN BY GT&T's EMPLOYEES, AGENTS OR CONTRACTORS (INCLUDING WITH RESPECT TO ANY EQUIPMENT THAT MAY BE RECOMMENDED FOR PURCHASE AND/OR USE WITH THE SERVICE) SHALL CREATE A WARRANTY.

  • GT&T shall not be liable for, and is excused from, any failure or delay in performance that is due to acts of God, acts of civil or military authority, riots, civil unrest, acts of the public enemy, war or threats of war, accidents, fires, explosions, earthquakes, floods, unusually severe weather, epidemics, or due to any other cause beyond its reasonable control.

  • UNDER NO CIRCUMSTANCES SHALL GT&T OR ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES THAT RESULT FROM CUSTOMER OR CUSTOMER'S USERS' USE OF OR INABILITY TO ACCESS ANY PART OF THE INTERNET OR RELIANCE ON OR USE OF INFORMATION, SERVICES OR MERCHANDISE PROVIDED ON OR THROUGH THE SERVICE, OR THAT RESULT FROM MISTAKES, OMISSIONS, INTERRUPTIONS, LOSS, THEFT, OR DELETION OF FILES, ERRORS, DEFECTS, DELAYS IN OPERATION, OR TRANSMISSION, OR ANY FAILURE OF PERFORMANCE.

  • Notwithstanding anything to the contrary stated herein, GT&T's maximum liability hereunder will not exceed an amount equal to the total of the monthly recurring charges paid by the Customer hereunder for the twelve (12) months preceding the month during which such liability arises.

  • The Customer shall defend, protect and hold harmless GT&T and its affiliates from and against any liabilities, actions, losses, costs, or claims incurred by them as a result of (i) any use or misuse of the Service (whether by the Customer or any other party), or (ii) any claims arising out of the use of any third party equipment or software with the Service based on the alleged infringement or misappropriation of any intellectual or other property rights of any third party.

  • GT&T and Customer expressly agree that this Agreement does not give rise to any third party being a third party beneficiary or being entitled to any rights whatsoever.

  • In the event an action is brought by GT&T against the Customer to enforce this Agreement, in addition to any other remedy available to GT&T, the Customer shall reimburse GT&T for reasonable attorneys' fees and expenses of any kind or nature incurred in connection therewith.
Additional Terms
  • Neither party may use the other's name in trademark, trade names or other proprietary identifying symbols without the prior written approval of the other party.

  • Any notice and similar communications concerning this Agreement ("Notice") will be in writing, and will be either (a) delivered in person, or (b) sent to the other party by (i) registered mail (with return receipt requested), (ii) facsimile (electronically confirmed and followed up immediately by regular mail), or (iii) electronic mail (followed up immediately by regular mail). A Notice will be considered given when delivered in the manner prescribed in this paragraph. Notices will be delivered or sent to the following addresses or to such other address as either party may hereafter establish by notice given in the manner prescribed in this paragraph: (i) if to Customer: to the relevant billing address, and (ii) if to GT&T: Attention: Michael George, Director Sales and Marketing, Telephone House, PO BOX 10628, Brickdam, Georgetown .

  • The customer's monthly invoice for the service fee shall be sent electronically to the customer via the email address given the customer at the time of service activation. Failure to receive the invoice shall not constitute an acceptable excuse for late payment or non-payment.

  • The Customer may not resell the Service or otherwise assign or transfer this Agreement or any rights or obligations without the prior written consent of GT&T.

  • In the event that one or more of the provisions herein is for any reason held to be illegal or unenforceable, this Agreement will be revised only to the extent necessary to make such provision(s) legal and enforceable; provided, however, that this Agreement as revised is consistent with the parties' original intent.

  • Either party's failure to insist upon strict performance of the terms of this Agreement or to exercise any rights or remedies hereunder shall not waive any of its rights to require strict performance of such terms, to assert any of the same rights, or to rely on any such terms any time thereafter.

  • This Agreement is made in, governed by and subject to the laws and the jurisdiction of the courts of Guyana.

  • Any cause of action the Customer may have with respect to the Service must be commenced within one (1) year after the claim or cause of action arises or such claim or cause of action will be barred.

  • GT&T and the Customer are independent contracting parties, and this Agreement will not constitute the parties as principal and agent, partners, joint-venture partners, or employer and employee.

  • No Customer Service Authorization or similar documents will vary or add to the terms of this Agreement.

  • This Agreement constitutes the entire understanding of the parties with respect to the subject matter hereof, and it supersedes all prior or contemporaneous oral or written agreements, understandings and representations.

  • GT&T reserves the right to change the prices for the Service at any time upon 30 days notice. Prices will be posted on the GT&T homepage: www.gol.net.gy. Current rates may also be obtained by calling 225-4001 extensions 2314 or 2329

  • GT&T may revise, amend, or modify this Agreement at any time and in any manner. Notice of any revision, amendment, or modification will be posted on GT&T's Web site and communicated to the customer in writing.
I ACKNOWLEDGE THAT I HAVE READ AND FULLY UNDERSTAND ALL OF THE TERMS AND CONDITIONS SET FORTH IN THIS AGREEMENT AND THAT I, AND ANY PERSON USING ANY SERVICES OR FACILITIES PROVIDED BY GT&T TO ME HEREUNDER, AGREE TO ABIDE BY THE TERMS AND CONDITIONS OF THIS AGREEMENT.
